General Terms and Conditions of Sale (GTCS)

Preamble : These general terms and conditions of sale (referred to as "GTCS") govern the contractual relationship between the seller, operating the e-commerce site specializing in the sale of paintings and card artworks (BENJAMIN FERSING), and any non-commercial individual (referred to as "the Customer") making a purchase on the website (benjaminfersing.com).

  1. Purpose : These GTCS aim to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller on the Site.

  2. Products : The products offered for sale are paintings and card artworks, presented with the greatest possible accuracy. However, slight differences may exist between the photographs of the products and the products themselves, particularly due to different screen display settings.

  3. Prices : Prices are indicated in euros, including all taxes (VAT included), excluding delivery costs. The Seller reserves the right to modify prices at any time, but products will be invoiced based on the rates in effect at the time of order validation by the Customer.

  4. Orders : The Customer places an order on the Site by following the detailed process. Any order validated by the Customer constitutes full acceptance of these GTCS. The Seller reserves the right to refuse any order in the event of a prior dispute with the Customer or for any other legitimate reason.

  5. Payment : Payment is due immediately upon order. The Customer can pay for their purchases by bank card or any other secure payment method indicated on the Site. Transaction security is ensured by a payment service provider.

  6. Delivery : Products are delivered to the address provided by the Customer when placing the order. Delivery times are provided for information purposes only. The Seller cannot be held responsible for delivery delays attributable to carriers.

  7. Withdrawal : In accordance with Article L. 221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties. Personalized products or products made to the Customer's specific order are not subject to this right of withdrawal.

  8. Returns : In the event of exercising the right of withdrawal, the Customer returns the products at their own expense in their original condition, complete and undamaged. The refund will be made within fourteen (14) days following receipt of the returned products.

  9. Warranties : The Seller is subject to the legal warranties of conformity and hidden defects provided for in Articles L. 217-4 to L. 217-14 of the French Consumer Code and Articles 1641 to 1649 of the French Civil Code.

  10. Personal : Data Protection Information collected on the Site is necessary for processing orders. The Customer has the right to access, rectify, and delete personal data concerning them by sending a request to the Seller.

  11. Intellectual Property : All content on the Site (texts, images, illustrations) is protected by copyright and is the exclusive property of the Seller.

  12. Disputes : These GTCS are subject to French law. In the event of a dispute, the Customer is invited to contact the Seller to seek an amicable solution. Failing that, French courts shall have sole jurisdiction.
